Terms and Conditions
Please read them carefully. Your use of this site indicates your
acceptance of these terms and conditions. Your placement of an order
indicates your acceptance of these terms and conditions. Your
submittal of any purchase order to Computer Gate.

conditions shall supercede any subsequent terms and conditions
included with any purchase order, whether or not such terms or
conditions are signed by Computer Gate. Computer
Gate. reserves the right to make changes to this
site and these terms and conditions at any time.
Payment Method
You may order products through this
on-line store using VISA, MasterCard, Discover and American
Express. To protect you against unauthorized charges, credit card
orders that are shipped to addresses other than your billing address
will require additional verification. All credit card orders are
subject to verification and approval.
Placing Order
To streamline your
purchase and eliminate the waiting time on the phone, all orders and
pricing shall be made through the Internet. The pricing on
the Internet will be a real time pricing. There is no phone call
order.
Shipping and Handling
Orders are usually shipped within 2
business day. Occasionally, orders may take up to 3 business day for
shipment depending on the availability. Normal shipping is UPS
Ground. FedEx 2-day and overnight service is available. Computer
Gate will add a $2.95 handling charge per order with an exception
$5.00 handling charge per order for all Post Office shipment.
Shipping and handling fees are non-refundable. All sales are FOB
Santa Clara, CA. All photographs are for illustration purposes only
and may not be a true representation of actual products. All
trademarks & logos are registered to their respective owners. We
are not responsible for typographical errors. All products sold by
Computer Gate are third party products and are subject to the
warranties and representations of the applicable manufacturers,
including but not limited to Y2K compliance. Accordingly, Computer
Gate makes no representation or warranty with respect to the Y2K
compliance of products sold.
Back Ordered Items
When products are back-ordered the following will apply:
1. If the back ordered product is scheduled to reach Computer Gate
warehouse within five (5)
business days, your order
will be held up in order to complete your shipment.
2. If a back ordered product will be out-of-stock more than 5
business days or has been
discontinued, our sales representative will inform by contacting
you about this matter.
Membership Eligibility
In order to deliver a better service to all members,
Computer Gate reserves the right to review all members'
performance. Members who do not have any activity within 3 (three)
months in a row will automatically be terminated (see reseller
benefits).
Returns and Refunds
Your satisfaction is guaranteed with any products purchased from
Computer Gate online within thirty (30) days of the invoice date. If
you are not satisfy with the products you can exchange or refunds
them.
All products returned to us must be accompanied by a Return
Merchandise Authorization (RMA). Contact our customer service
department to obtain an RMA number or you can request RMA number by
submitting the form online.
We need this information in order to issue an RMA:
(1) invoice number (on your original invoice)
(2) serial number
(3) the nature of the problem.
All RMA numbers issued are good for fifteen (15) days from the date
of issued. Prepaid shipping is required for all returning products.
A copy of your original invoice is required to process your return.
Returned merchandise must be in original, new, re-sellable condition
and be accompanied by all original packaging, documentation and
accessories. Therefore please check the packaging and label
carefully to be sure you receive the correct product and version. In
all cases, returned product must be shipped prepaid with an approved
RMA number clearly shown on the shipping label.
Shipping and handling are not included in the refund. Computer Gate
reserves the right to refuse merchandise or impose a minimum of 15%
restocking fee for any returns not meeting the above requirements.
All merchandise must be received before any refunds or replacement
can be processed (no cross-shipping). Please allow two (2) weeks for
processing. Opened software may be returned only if defective and
then only for replacement, not for refund. Opened consumable
supplies may not be returned or refunded.
No price protection on all our products: As you know prices
fluctuate daily in computer business, just like stock market. In
order for Computer Gate to keep the best price for our customers, we
cannot accept product return because of the price fluctuation.
Several manufacturers' policies require that you contact them
directly for assistance regarding their products. These
manufacturers will replace, return or repair the products according
to their policies:

Manufacturer's
warranties vary on each product. Manufacturer's warranty information
is subject to change without notice. If your products are not made
by one of the manufacturers mentioned above, the following policy
applies:
OEM Package:
OEM products usually come with a brief manual and other accessories
such as driver, but not include warranty card. However, some
products are sold without any accessories, driver etc. (we called it
as bulk pack). After 30 days guarantee period and your OEM product
is not functioning properly, we can only exchange or repair the
product within 90 days of the invoice date, except for OEM CPU,
memory and motherboard, NO refund or exchange after 30 days (Apacer
memory is an exception).
Retail Box:
Product sells in retail box (has original manufacturer packaging and
warranty card inside the box) carries manufacturers warranty. Please
check manufacturers website for more information.
Warranty Disclaimers/ Limitation of Liability
Computer Gate expressly disclaims all warranties
either expressed or implied, including any implied warranty of
merchant ability or of fitness for a particular purpose. Computer
Gate shall have no liability to anyone for incidental or
consequential damages or any other liability, loss or damage arising
out of or related to the merchandise, even if Computer Gate or a
Computer Gate authorized representative has been advised of the
possibility of such damages. All merchandise sold "As is ".
Computer Gate makes no warranty as to the performance of any
merchandise sold. Computer Gate is not responsible for system
downtime, lost data or any other damages. This is disclaimer by
Computer Gate in no way affects the terms of a manufacturer's
warranty, if any.
Typographical and Misprinted Errors
We are not responsible for
typographical or pictorial errors and make every possible effort to
avoid them. We reserve the right to change or correct prices or
substitute products and manufacturers. Item picture may be
representative items only! Specifications and descriptions subject
